All mentions of AgentCorrina in this document refer to the Deviantart user AgentCorrina.

By purchasing or obtaining any designs, custom work, Celestial Seas MYO slots, and Celestial Seas species designs produced by or for the agentcorrina account on Deviantart, Agentcorrina account on Patreon, or this website you automatically agree to all terms listed in this document.

Sales cannot be conducted with any persons under the age of 18. We do not knowingly conduct sales with people under the legal age. If you are under the age of 18 you may only obtain designs via gift, raffle, trade, or by having a person who is 18 years or older purchase it for you.

When a design is transferred to a user who is not a member of this website, you must provide a link to this page so that the new owner is aware of the ownership terms.

Terminology

"Adoptable" or "Adoptables" refers to any character design you have obtained trough purchase, trade, gift, or raffle that you did not create yourself.

"MYO" or "MYO Design" refers to a character design of one of our official species created from a MYO Slot or that was made with permission directly from Corrin.

"Closed Species" means that the species browbirds, kitbulls, and painted satyr cannot be created without an officially obtained MYO slot or explicit written permission from AgentCorrina and attempts to do so will ban you from our community.

"Slot" can refer to a "MYO slot" or "custom slot" depending on context. 

★ TERMS OF USE ★

★ GENERAL TERMS:

✦ Any artist who has created Celestial Seas artwork or Celestial seas designs can display it in their own personal galleries and use the artwork they have created for their own promotional purposes and portfolios. 

✦ Celestial Seas designs cannot be used commercially unless you are granted explicit written permission to do so. 

✦ Do not trace or alter the original artwork of Celestial Seas character designs created by any user without asking for.

✦ All character designs and MYO slots can be gifted for free to another user at any time.

✦ If a design was obtained initially via purchase it can be resold for up to that amount, or exchanged to another user for an agreed upon "voucher" to purchase something else for no more than $100 over the original amount. 

✦ If a design was obtained initially via trade with the AgentCorrina deviantart account, it can only be traded for other designs, artwork, or other goods and services. It cannot be sold or exchanged for a monetary voucher. 

✦ Link back to the website, group, or the AgentCorrina account if you post depictions of our closed species so new users can find us!

✦ We have the ability to revoke full or partial rights to any design, however such actions are reserved for cases that involve designd that have not been paid for or for certain violations of our terms. We do not "take back" designs that were rightly obtained for all TOS violations, but we may remove that design from our official rouster and website, and/or bar you from using that design to participate in our community.

 ★ PAYMENT ★  

✦ Any transactions involving real-life currency will not be knowingly conducted with and should not be directly offered to users under the age of 18. However, these sales will still be advertised, linked to, posted, or promoted through this service. 

Users under the age of 18 are still able to participate, and are able to obtain character designs via trade, raffle, or gift. If you are having someone 18 years or older purchase a design for you, you must contact Celestial Seas staff via the group or contact AgentCorrina directly before claiming the design or slot. 

If you are found to have purchased a design while being under the age of 18, have sold a design to someone under the 18, or if you yourself are someone under the age of 18 attempting to sell a Celestial Seas design your account may be terminated. 

✦ Chargeback
A "chargeback" in this case reversing a transaction to have money spent on a character design or slot returned to you, even if you have recieved the design. In the case of a chargeback against any official Celestial Seas sale, you will no longer hold rights to the character design since it has not been paid for, and we will be able to sell it to a different user if you are not able to properly pay within 48 hours. Chargebacks, even if accidental, may result in you no longer being allowed to participate in sales or being permanently banned from our community.

✦ Refunds
All sales of Celestial Seas designs are final and cannot be refunded unless at the digression of the artist. If a refund is given for any reason, the artist has the right to reposes the design as it has not been paid for.

✦ Payment Plans
We allow payment plans on certain design sales. These plans are discussed with the artist first. You do not hold allowed rights to a design until the payment plan has been completed. 

✦ Customs
A "custom" or "custom slot" is a design that has been/will be created for you. Custom "slots" cannot be traded or sold. If a custom"slot" or finished custom is refunded for any reason, you will not have rights to the design.

✦ Official Adopt Sales
Rights to a design do not transfer until a design has been fully paid. Backing out of a sale before or after claiming a design or winning an auction could see the offending user banned from future sales. 

Backing out before the auction concludes/before you are chosen as the winner of a claimed design AND alterting staff before doing so avoids any suspension or bans. 

Hiding claim comments without alerting staff will see you suspended from sales.

Backing out of any sale or auction after it has concluded and you have been chosen as the winner will result in a permanent ban from sales.

Do not claim or bid with money you do not have and cannot commit to spending. We take these situations very seriously due to the difficult nature of re-hosting sales and the delay in our artists being paid for their work.

★ OWNER RIGHTS ★

★ DESIGN AND ART USAGE

✦ The owner of any designs, adoptables, or artwork created or sold by @AgentCorrina and all designs sold under the Celestial Seas name are created and sold for non-profit, personal use. These designs and artworks cannot be used commercially without explicit written permission from both the original artist and AgentCorrina. 

 

✦ Personal use of design's original artwork or commissioned artwork (ie: artwork not made by you) would be as follows: 

• Roleplay and other written work
• Creating personal artworks, plushies, comics, or other visual art of the design.
• Commissioning other artists to create artworks of the design.
• Any printing done of the design as long as it is not being mass produced or sold for profit (Shirts, charms, buttons, ect).
• Any personal projects that are not being created to make a profit.
• Any additional restrictions placed on use of the artwork by the creator as long as they would not conflict with the species terms of service or ownership guidelines
• Posting the design or artwork to your online galleries or character hubs, so long as credit is provided to the original artist

 

✦ Personal use of artwork made by you as the owner of a design:

You, as creator of the artwork, are able to use artwork created by you of these designs in your portfolio and for your own promotional use for non-profit projects.
You, as creator of the artwork, are allowed to do limited runs of the piece featuring artwork of the designs so long as it was created by you. (Ex: Selling prints of the artwork at a convention) 

When you create artwork featuring Celestial Seas characters or locations, we still hold the rights to those locations but you are allowed to freely use them in your personal artwork relating to Celestial Seas. 

✦ Usage of designs based from a design owned by you

We allow owners of designs to create or commission personal versions of designs heavily based on the original Celestial Seas design that they currently own.
• An example would be if you were to commission a custom design from another artist for a design with the intent of it being essentially the same design you own, simply as a different "species". 
• Another example would be if you created a Celestial Seas design or commissioned a Celestial Seas design with the intent of it being heavily based on a prexisting design that you own.

Failure to keep designs created under these circumstances together with the original could cause you to be banned due to copying or reproducing Celestial Seas designs for personal gain, which we would consider as using Celestial Seas designs commerically.

This rule is to be respectful to designers who do not want their work copied or reproduced and sold  separately without permission. If you are not comfortable with this rule, then please do not recreate existing characters using our species or create designs heavily based on celestial seas designs.

What does not count for this rule is if you happen to obtain a Celestial Seas design and decide to "link" it to a prexisting character, or if you own a Celestial Seas design and link a new design you obtain to it. These designs were NOT created with the intent of being "the same character" and will often have enough visual differences to set them apart.

✦ The current owner of a design or artwork is able to post the design or artwork on other websites even if they did not originally create it.
This would mean any artwork depicting their character that was obtained alongside that character, and the original design of the character. When posting designs or artwork not created by you, credit must be provided in the form of a visible link back to the artist's online website or gallery.

✦ In the case of Celestial Seas artwork or designs being used for illegal or harmful content:
Using Celestial Seas character designs for any content that is illegal, hateful, harmful, offensive, or in violation of the rights of others risks an immediate ban without appeal. And we do not support or endorse our character designs or closed species being used that way.

We do not knowingly allow users who participate in content that breaks our terms of services or community guidelines access to our website or services. And we do not knowingly do business with such users. 

★ CO-OWNING

✦ Users are able to organize co-ownership of designs they currently own
"Lending" and "Co-ownership" of any Celestial Seas character design is done at the risk of the users involved and is not officially supported by Celestial Seas staff. We are not obligated to help you in the event of a coownership dispute. Each design will still have a sole owner on our masterlist and that user holds the power to transfer that design and use them for prompts. 

★ DESIGN CHANGES

Large Changes:
Large changes must be approved by staff. 
• Adding new traits not previously present on the design
• Changing the design's supspecies/subtype
• Removing traits from a design
• "Rarity swapping"
• Changing the rarity of traits present on the design
• The use of trait or specialty items 
• Changing more than 10% of the design's color coverage
• Changing any color on the base design by more than 10%

✦ Small changes
"Small" Changes are made at the owner's own disgression and do not require approval. However, remember that you will have to submit for a design change if you want the small changes officially displayed on the masterlist.
• Changing the fur placement or amount of fur on a character
• Changing the character's hair color or hair style
• Changing the character eye, nail, mouth, or teeth color
• Adding scars or removing a limb or eye from a character
• Adding small accent markings (such as tiny dots, or "makeup")
• Adding slight gradients to areas
• Changing the height, age, gender, or backstory
• Changing outfit designs, or creating a new outfit design (should not be enchanted)
• Giving your character wepon(s), "inventory items" or armor (Should not be enchanted or made to resemble prexisting canon items so that it could be misleading)

★ MYO GUIDELINES ★

★ GENERAL MYO GUIDELINES

✦ Browbirds, kitbulls, and painted satyr are closed species created by AgentCorrina and owned by Celestial Seas. They are not available to be made for free unless you are given explicit written permission by AgentCorrina. 

✦ There is no time limit in which a MYO slot has to be completed nor is there any transfer cooldown imposed on created MYO designs.

✦ MYO "Slots" by themselves CANNOT be traded or sold for any reason.
Once the MYO is uploaded to the masterlist as a finished design the transfer rights will be added. Trading or selling of finished character designs that have been approved will depend on the MYO slot type and how it was obtained. While you are not able to trade or sell an unused slot, you may give the slot away for free. 

✦ The owner of a slot is able to have another user design the slot's design for them.
Please submit artist credit when sending in a MYO for approval. Keep in mind that any amout paid to have another user design your MYO for you will not be included when the final MYO design is uploaded to our masterlist and that you will still not be able to add additional real life currency on during design resale or trading nor will it make designs obtained for free able to be sold or traded.

✦ The owner of the slot must be the one to send in the finished design for approval. 
We will not approve of any MYO design submitted by anyone other than the slot holder.

✦ All MYO Slots are one time use and cannot have additional designs created from them.

✦ Once a MYO design is approved and uploaded to the masterlist it will consume the slot, it CANNOT be reverted to a slot for any reason. 

★ Standard Slots / Platinum Slots / "Plat" Slots

Standard MYO slots of browbirds, kitbulls, and painted satyr can only be obtained through USD sale or trade with the AgentCorrina account. 

✦ If the initial slot was purchased for USD or points, the final design created from the slot can be traded or sold. Resale price should not exceed the original sale price. 

✦ If the initial slot was obtained via a trade originally by trading directly with AgentCorrina to obtain said slot without any USD being paid to Agentcorrina , then the final design created from the slot can be traded but not sold.

★ Gold Slots / Golden Slots / Shop Slots

Shop MYO slots of browbirds, kitbulls, and painted satyr are obtained through the @Celestial-Seas ingame shops and are purchased with fictional "currency" called stargold or are obtained through special offers and items. 

✦ "Gold Slots"/"Shop Slots" can be transferred to other users while it remains an item. This item can be converted into a useable MYO slot. While it is being exchanged as an item, standard item rules apply.  Once it is converted into a MYO Slot it can no longer be transferred until the final design is approved and uploaded. 

✦ As these slots were not purchased using real life currency, they cannot be sold for real life currency when their final design is added to the masterlist. 

 

★ Prize Slots / Raffle Slots / Gift Slots

Prize MYO slots of browbirds, kitbulls, and painted satyr are obtained for free via events in the group, certain raffles, or are given directly from AgentCorrina. 

✦ These slots and the designs created from them cannot be traded or sold and may only be given away for free or returned to staff.

★ Finished MYO Designs

The finished MYO design must be approved and uploaded to the masterlist before it is posted publically to Deviantart or other online art galleries, portfolios, and websites.

✦ The sole exception to posting unofficial MYO designs publicly is if it is posted in our discord and you currently own the slot to back up the design.

✦ MYO designs CANNOT be gifted, traded, or resold without their final design being present on the masterlist. You MUST get the design on the masterlist before it can change hands.

★ RESELLING AND TRADING ★

★ TRADING OR RESELLING CLOSED SPECIES

Trading, purchasing, and reselling closed species designs second hand is done so at the risk of the user. Do not do business with someone that you do not trust. @agentcorrina and @Celestial-Seas are not responsible for reimbursing users in the case of a scam or breaking of these terms. Any issues are to be handled between the users conducting the trade or resale.

If you feel you have been scammed or that a user is violating the resale or trading terms, contact us privately. We may be able to take action but we can not guarantee you will get your money or designs back.

It is the responsibility of both the buyer and seller/both users participating in a trade to fully read and understand these terms.  

✦ Sales should not be knowingly conducted with any users under the age of 18.

✦ No one is required to sell or trade to you.

✦ All official designs, their resale value, and transfer availability can be seen on the masterlist.

✦ All ownership transfers are handled by transferring or trading the design on this website to another user. These transfers are handled automatically, but may take some time to go through. When a design changes hands, please also leave a comment on the Deviantart masterlist so our moderators can update it as well.

✦ If a design is not on the masterlist, it cannot change hands. Please let us know if the masterlist is missing your design.

✦ Designs with a price listed in their description can be resold for up to that price regardless of how you obtained it. 

✦ If there is no price listed in the masterlist description, a design cannot be sold or exchanged for vouchers for any reason.

✦ If a design is listed as being obtained via "gift", "prize", or "raffle" it cannot be traded or sold for any reason. 

✦ If a design is being resold to another user it cannot be sold for more than the price listed in its masterlist description.
In the case of additional art The current owner can add additional USD to the price of a design if there is additional artwork included of the character. This extra cost cannot exceed $100 even if the artwork's "worth" exceeds that price. This price will not be reflected on the masterlist and will not become the new listed price.

✦ Any "soulbound" items, companions, or designs that are attached to the Celestial Seas design that were obtained at the time of sale cannot be separated from it. 

✦ Designs that have been obtained second hand through trade, but have a price listed on the masterlist can still be resold for that price regardless of how you obtained them as the new owner. 

✦ No additional rules or terms added on to trades or resales by individual users are officially supported by Celestial Seas and we will not enforce them. We still ask that you are respectful towards other owners and artists in cases like these and use your best judgement. 

★ VOUCHERS

Vouchers are considered the same as reselling a design.
If a design cannot be sold, it cannot be exchanged for a voucher for any reason. 

A "voucher" is exchanging a design so that someone else purchases goods or services for you with the intent of obtaining a design from you. This would include purchasing other designs and purchasing merchandise.

✦ A voucher can be arranged for any design that has a price listed on the masterlist.

✦ Vouchers cannot exceed $100 more than the listed masterlist price of the design.

★ ARTIST RIGHTS ★

These artists rights cover any artist who has created artwork for Celestial Seas or has created an approved Celestial Seas design.

✦ Artists of designs under the Celestial Seas name are able to post designs they create to any of their online galleries, use them for portfolios, display them on personal websites or pages, and use them for self-promotional purposes. 

✦ It is the artist's right to decline any sale, auction purchase, or commission for any reason without warning or explanation.

✦ Artists of Celestial Seas designs should always be visibly credited when Celestial Seas designs created by them are posted to other websites.

★ BEING BLACKLISTED OR BANNED

Being "blacklisted" or "banned" will revoke certain privileges from the offending user relating to officially hosted sales, officially hosted events, website use, and/or community activity.

All bans are handled on a case by case basis and the action taken will directly relate to the ban reason. Not all possible punishments will be given on each case.

If another user is violating any terms, please contact staff privately.

Soft Banning
A soft ban will ban you from specific parts of Celestial Seas. These can sometimes be temporary, and can often be appealed if you contact staff directly and discuss it with us. 

Soft bans would be as follows, but are not limited to:
•  Backing out of official sales twice: You will no longer allowed to purchase designs from official sales, but can still trade and buy from other users and participate in the community and use the website. We usually allow two offenses, but if you are to back out after "autobuying" a design we may jump straight to a soft ban.
• Trading or reselling a design that cannot be traded or resold: You will no longer be allowed to sell or trade with to other members of the community, but you can still participate in the community, use the website, and purchase from official sales.
• Disruptive community behavior: Being disruptive to the community and breaking minor rules (at moderator disgression) may result in you being banned from the discord, but you can still use the website, participate in sales, and conduct trades.

Hard Banning
A hard ban completely bans you from the  website, Deviantart group, and discord and will not be reversed unless new information arises that counteracts what we know and proves you innocent. Hard bans are an extreme circumstance reserved only for when there are violations of the rights of others, harmful or illegal activity in the community, and using our community or services to scam money, designs, artwork, or items out of other users.

We do NOT "take back" or "revoke" designs for any reason including if a user has been banned unless that design has not be rightfully obtained, such as not being fully paid for.
